Madam Counselor Decodes Fair Use for Writers
To decide fair use cases, courts use a rubric composed of four factors: the purpose and character of your use, the nature of the copyrighted work, the amount and substantiality of the portion taken, and the effect of the use upon the potential market. But this framework isn’t the most helpful for regular people making real-life decisions about their art. This workshop goes beyond the four factors of the fair use test to provide a framework and resources for assessing real-life fair use applications in fiction and to keep writers OUT of the Cease and Desist Zone.
